Court Denies Benefits for Daughter Conceived After Dad's Death

The Eighth Circuit Court of Appeals in Iowa ruled yesterday that an 8-year-old girl conceived through in vitro fertilization two years after her father's death is not eligible to receive his Social Security benefits.

A year after Bruce Beeler died of leukemia at the age of 37, his wife Patti conceived a child through artificial insemination using semen the couple had banked for that purpose. Their daughter Brynn was born in April 2003.

Despite legal documents signed by Bruce acknowledging that he accepted to pay child support for any child or children, Patti was denied Social Security benefits for the girl when she applied in June 2003.
